Gehörschutz wird im Allgemeinen dann benötigt, wenn eine dauerhafte oder periodische Lärmbelastung am Arbeitsplatz besteht. Rechtlich ist das Bereitstellen von Gehörschutz durch den Arbeitgeber ab einer Lärmexposition von 80 dB(A) verpflichtend. Jedoch muss der Gehörschutz erst ab einer Lärmexposition von 85 dB(A) dauerhaft getragen werden – bei Werten unterhalb dieser Grenze steht es dem Arbeitnehmer natürlich frei, den Gehörschutz trotzdem zu tragen. Eine Ausnahme-Regelung gilt für Menschen, die bereits Schäden am Ohr haben. So besteht eine Tragepflicht beispielsweise für Menschen mit Innenohrschäden bereits ab 80 dB.
Neben der Bereitstellung hat der Arbeitgeber auch dafür Sorge zu tragen, dass der Gehörschutz von den Mitarbeitern getragen wird. Hierzu müssen in den entsprechenden Arbeitsbereichen mit hohem Lärmpegel passende Gebotszeichen angebracht werden, welche auf den Lärm hinweisen und auf die Tragepflicht eines Gehörschutzes hinweisen.
